An Opa-locka man who shot and killed two unarmed men outside a Chili’s restaurant should be immune from prosecution under Florida’s self-defense law, a Miami appeals court ruled Thursday.
The ruling, which for now clears Gabriel Mobley of two counts of second-degree murder, marks the first time that Miami’s appeals court has granted immunity to someone under Florida’s controversial Stand Your Ground law.
The Third District Court of Appeals, in a 2-1 decision, overturned an earlier ruling by a Miami-Dade judge denying immunity to Mobley.
